MAPNEEDS – TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of all products and services provided by MapNeeds (“MapNeeds,” “we,” “us,” or “our”), including but not limited to our websites, web applications, dashboards, analytics tools, alerts, emails, messages, bots, Discord or other community channels, content, and any related services (collectively, the “Services”).

By accessing or using the Services, you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Services.

1. NATURE OF SERVICES – EDUCATIONAL & ANALYTICS ONLY

1.1 Informational and Educational Purpose Only

The Services are provided solely for informational and educational purposes. The Services may include, without limitation:

Market analytics and quantitative metrics
Charts, indicators, and technical analysis tools
Automated or semi-automated alerts and notifications
Visualizations of price, volume, volatility, and related data
Illustrative risk metrics (including “approximate risk” values)
Hypothetical examples and backtests
General commentary on trading psychology and risk management

These materials are intended to help you learn and conduct your own analysis, not to tell you what to do with your money.

1.2 Not Investment, Financial, or Trading Advice

The Services do not constitute and must not be construed as:

Investment advice
Financial advice
Trading advice
Legal, tax, or accounting advice
A recommendation or solicitation to buy, sell, or hold any security or financial instrument

At no point does MapNeeds:

Take into account your personal financial situation, needs, objectives, risk tolerance, or time horizon
Provide personalized recommendations
Advise you to enter, exit, or modify any specific trade

Any decisions you make are entirely your responsibility.

2. REGULATORY STATUS – NO REGISTRATION, NO ADVISORY RELATIONSHIP

2.1 Not a Registered Advisor or Broker

MapNeeds is not:

A registered investment adviser
A broker-dealer
A futures commission merchant
A commodity trading advisor

MapNeeds is not registered with the:

U.S. Securities and Exchange Commission (SEC)
Financial Industry Regulatory Authority (FINRA)
Commodity Futures Trading Commission (CFTC)
Any state or foreign securities or financial regulator

2.2 No Fiduciary Duty

Your use of the Services does not create any advisory, fiduciary, client, or professional relationship between you and MapNeeds. We owe you no fiduciary duty. You agree that:

You are not relying on MapNeeds as your advisor
You remain solely responsible for evaluating all information and making all trading and investment decisions

3. HIGH RISK OF TRADING – RISK DISCLOSURE

3.1 General Trading Risk

Trading and investing in securities, derivatives, cryptocurrencies, and other financial instruments involves substantial risk of loss and is not suitable for every person. You may lose all or more than your initial investment.

By using the Services, you explicitly acknowledge that:

Markets are volatile and unpredictable
Price movements can be sudden and extreme
Slippage, gaps, halts, and illiquidity may occur
Use of margin and leverage can magnify losses and risks

3.2 Past Performance Not Indicative of Future Results

Any historical data, simulated performance, examples of trades, or backtested results displayed or discussed through the Services are hypothetical or for illustration only and:

Do not reflect actual future performance
Do not guarantee any outcome
May differ significantly from real trading results

3.3 Responsibility for Your Own Decisions

You are solely responsible for:

Assessing your own financial situation and risk tolerance
Determining whether trading or investing is appropriate for you
Implementing your own risk management rules
Selecting your own stop-loss levels, position sizes, and strategies

MapNeeds has no control over your trading decisions and accepts no liability for any outcomes.

4. MARKET DATA, ANALYTICS & ACCURACY

4.1 Data Sources and Nature of Analytics

Market data, analytics, and outputs provided through the Services may be derived from a variety of internal and external sources, including but not limited to:

Publicly available market information
Standardized or aggregated data feeds
Algorithmic calculations
Derived metrics and proprietary formulas

All displayed metrics (including, but not limited to, price levels, volatility ranges, momentum measures, volume statistics, “approximate risk” for a given share quantity, and stop-loss illustrations) are informational estimates only.

4.2 No Guarantee of Accuracy or Timeliness

You understand and agree that:

Data may be delayed, incomplete, inaccurate, or out of date
There may be errors, omissions, interruptions, or inaccuracies in prices, volumes, indicators, and analytics
System latency, connectivity issues, or third-party failures can affect the availability and correctness of the information

MapNeeds does not guarantee the accuracy, completeness, reliability, timeliness, or availability of any data or analytics.

4.3 Use of “Approximate Risk” and Educational Stop-Loss Lines

The Services may display values such as “approximate risk for [X] shares based on a recent price level” or show hypothetical stop-loss lines on charts for educational and illustrative purposes only. These are:

Descriptive metrics showing distance between price and a reference level
Not instructions to use that exact amount or level
Not personalized recommendations

You must not interpret any such values or chart lines as advice to:

Set your stop-loss at a particular price
Risk a specific dollar amount
Enter or exit any trade

You alone are responsible for any stop-loss or risk levels you choose.

5. ELIGIBILITY & USER ACCOUNTS

5.1 Eligibility

To use the Services, you represent and warrant that:

You are at least 18 years old or the age of majority in your jurisdiction
You have the full right, power, and authority to agree to and be bound by these Terms
Your use of the Services does not violate any applicable laws or regulations

5.2 Account Registration and Security

You may be required to create an account to access certain features. You agree to:

Provide accurate and complete information
Keep your login credentials secure and confidential
Not share your account with others
Promptly notify us of any unauthorized access or suspected breach

You are solely responsible for all activities occurring under your account.

6. LICENSE TO USE THE SERVICES

6.1 Limited License

Subject to these Terms, MapNeeds grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your own personal, non-commercial, educational, and research purposes.

6.2 Prohibited Uses

You agree not to:

Use the Services to provide investment advice to third parties
Represent MapNeeds analytics as your own proprietary service to clients
Resell, sublicense, or redistribute data, analytics, alerts, or content without our prior written consent
Reverse engineer, decompile, or attempt to derive any source code, formulas, or algorithms
Scrape, harvest, or systematically download content or data from the Services
Interfere with or disrupt the operation of the Services
Use bots or automation to overload or abuse the system beyond intended usage
Circumvent or attempt to circumvent any access control or security measures

Violation of these restrictions may result in immediate termination of access and may incur civil or criminal liability.

7. SUBSCRIPTIONS, FEES & REFUND POLICY

7.0 Free Access and Future Paid Plans

Portions of the Services may currently be offered free of charge (“Free Access”). MapNeeds may introduce paid subscriptions, premium features, or one-time purchase options in the future.

Users will never be charged for any paid plan unless they:

Voluntarily opt in to a paid membership,
Select a specific paid tier,
Provide valid payment information, and
Explicitly authorize the transaction through our payment processor.

Free Access users will not be automatically upgraded or migrated into paid plans under any circumstances.

Any future introduction of paid services will be communicated clearly, and users may decide whether they wish to upgrade.
Users who do not select a paid plan will continue on Free Access without charges.

7.1 Subscription Plans and Payments

Some parts of the Services may require payment of subscription fees or one-time charges. By subscribing to any paid plan, you agree to:

Pay all applicable fees in the currency and at the rate displayed at the time of purchase.
Provide valid, accurate, and up-to-date billing information.
Authorize MapNeeds or its designated payment processor to charge your selected payment method on a recurring basis, if applicable, until you cancel.

All fees are billed in advance and grant access to the selected paid services for the specified billing period.

7.2 Automatic Renewal

Unless explicitly stated otherwise, paid subscriptions renew automatically at the end of each billing term (e.g., monthly or annually).

You agree that:

Renewal will occur at the then-current subscription rate;
Charges will be processed using the payment method you provided;
You are solely responsible for managing your subscription, including cancellations;
You may cancel your subscription at any time through your account or payment provider to prevent future renewal charges.

Canceling a subscription stops future billing but does not retroactively refund previously charged periods.

7.3 No Financial Performance Guarantees

Subscription fees, premium access, or any paid features are purchased exclusively for access to tools, analytics, data visualizations, reports, features, alerts, and educational resources—not for performance outcomes.

MapNeeds does not guarantee and is not responsible for:

Your profitability or trading results;
Improvements to your performance;
Accuracy, completeness, or timeliness of any analytics, metrics, or alerts;
Any decisions made or actions taken based on the Services.

All trading and investment decisions remain solely your responsibility.

7.4 Refund Policy

Unless explicitly stated otherwise in writing, all payments are final and non-refundable. This includes, without limitation:

Partial months or partial subscription periods;
Unused access, features, or benefits;
Dissatisfaction with market outcomes or personal trading results;
Failure to use the Services after purchase;
Accidental purchases or unintended renewals unless prohibited by applicable law.

Refunds are not provided for subscription cancellations.
Canceling prevents future charges but does not provide a refund for the current billing period.

8. COMMUNITY FEATURES & USER CONTENT

8.1 Community Channels

If the Services include chat rooms, Discord servers, forums, comments, or similar features, you agree to:

Behave respectfully and lawfully
Not harass, threaten, or abuse others
Not share obscene, defamatory, or hateful content
Not promote scams, pump-and-dump schemes, or misleading information

We may moderate or remove content at our discretion but are not obligated to do so.

8.2 User-Generated Content

If you post, upload, or otherwise submit any content (“User Content”) through the Services, you grant MapNeeds a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:

Use, reproduce, modify, adapt, publish, translate, and display such content in connection with operating and improving the Services

You represent and warrant that you have all rights necessary to grant this license and that your User Content does not infringe the rights of any third party.

9. INTELLECTUAL PROPERTY

9.1 Ownership

All content and materials made available through the Services, including but not limited to:

Text, graphics, charts, and dashboards
Logos, trademarks, and branding
Software, code, and scripts
Indicators, formulas, and analytics
Layouts, designs, and user interfaces

are the exclusive property of MapNeeds or its licensors and are protected by copyright, trademark, and other intellectual property laws.

9.2 Restrictions

Except as expressly permitted in these Terms, you may not:

Copy, modify, or create derivative works based on the Services
Remove or alter any proprietary notices or marks
Use any MapNeeds trademarks without our prior written consent

10. THIRD-PARTY SERVICES & LINKS

The Services may include links or integrations with third-party websites, platforms, brokers, charting tools, communication apps, or other services.

You acknowledge and agree that:

MapNeeds does not control and is not responsible for third-party services
We do not endorse or guarantee any third-party products, content, or practices
Your use of any third-party service is at your own risk and subject to their own terms and policies

We are not liable for any damages or losses arising from your interaction with third parties.

11. AI, AUTOMATION & EXPERIMENTAL FEATURES

The Services may include AI-generated analytics, commentary, summaries, or other automated outputs.

You understand and agree that:

AI-generated content may be incomplete, inaccurate, or inconsistent
Automated systems can fail, misinterpret data, or behave unpredictably
Such content is provided “as is” for informational purposes only and must be independently verified

You must not rely solely on AI or automated outputs for making trading or investment decisions.

12. DISCLAIMERS OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

MAPNEEDS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY, COMPLETENESS, OR RELIABILITY OF DATA OR ANALYTICS
AVAILABILITY OR UPTIME OF THE SERVICES

We make no warranty that:

The Services will meet your requirements
The Services will be uninterrupted, timely, secure, or error-free
The results obtained from the Services will be accurate or reliable

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MAPNEEDS OR ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY:

DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES
INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF TRADING CAPITAL, LOSS OF OPPORTUNITY, OR OTHER INTANGIBLE LOSSES

ARISING OUT OF OR IN CONNECTION WITH:

YOUR ACCESS TO OR USE OF THE SERVICES
ANY RELIANCE YOU PLACE ON DATA, ANALYTICS, OR CONTENT
ANY TRADING OR INVESTMENT DECISIONS YOU MAKE

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless MapNeeds and its owners, officers, directors, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

Your use of the Services
Your trading or investment activities
Your violation of these Terms
Your violation of any law or regulation
Any claim that your User Content or conduct infringes upon the rights of any third party

15. MODIFICATIONS TO THE SERVICES AND TERMS

15.1 Changes to the Services

We reserve the right, at any time and without prior notice, to:

Modify, suspend, or discontinue any part of the Services
Introduce new features or impose limits on certain features
Correct errors or make routine improvements

We are not liable for any modification, suspension, or discontinuation of the Services.

15.2 Changes to the Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page.

Your continued use of the Services after any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Services.

16. TERMINATION

We may, at our sole discretion and without prior notice, suspend or terminate your access to the Services for any reason, including but not limited to:

Violation of these Terms
Misuse of the Services
Abusive or harmful behavior toward staff or other users
Attempted reverse engineering or unauthorized access

Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination (including, without limitation, disclaimers, limitations of liability, and indemnification) shall survive.
